The Legality of CBD Products in Florida in 2023

The Legality of CBD Products in Florida in 2023

CBD is legal in the state of Florida. After years of being opposed to legalization, Florida has finally made hemp-derived CBD lawful. Residents may now enjoy all of the benefits of CBD.

Following the passage of the 2018 Farm Bill, Florida now only authorizes CBD products containing up to 0.3% THC. Any quantity in excess of this is still unlawful.

When it comes to cannabis legislation, Florida is extremely progressive. Residents with a medical marijuana card can buy CBD oil with a high THC content if they have one of the qualifying ailments. If you want to buy CBD oil in Florida, you have two choices: shop online at somewhere like https://www.insidecbd.net/blog/fort-lauderdale-cbd-stress-relief or find a reputable dealer in your area.

Below, we will go through both approaches, as well as Florida’s rules governing cannabis and its derivatives.

Is Marijuana Legal in Florida?

Yes, medicinal marijuana is permitted in Florida, but only for registered patients. Recreational marijuana is still prohibited in Florida. Recent initiatives, such as the Florida Marijuana Use and Growth Legalization Initiative, have failed, but politicians are likely to try again in 2024.

Currently, possession of less than 20 grams of marijuana can result in a year in prison and a fine. Anything above 20 grams will land you in jail for up to 5 years. Even if your offence has nothing to do with driving, your license might be suspended.

Is CBD Oil Legal in the State of Florida?

In Florida, hemp-based CBD products are only authorized on a federal basis. Historically, the 1970 Federal Controlled Substances Act classified all cannabis forms, including hemp and marijuana, as Schedule I narcotics.

Schedule I narcotics are described by the law as medications, substances, or compounds that have no established medical purpose in therapy in the United States, and have a high potential for misuse, and lack any accepted safety for use under medical supervision.

The 2018 Hemp Farming Act, which distinguished hemp from marijuana, was passed by Congress. This statute defines hemp as cannabis that has less than 0.3% THC by weight, whereas marijuana contains more.

CBD extracted from hemp plants was no longer classified as Schedule I under the revised standards. Despite this, marijuana-derived CBD remained legally banned due to its high THC percentage.

Furthermore, the adoption of the 2018 Farm Bill permitted the US Food and Drug Administration (FDA) to oversee the market circulation of CBD.

Despite the FDA’s ongoing review of CBD products, firms cannot sell CBD products as dietary supplements or make unfounded therapeutic claims.

The Advantages of Buying CBD Products Online in Florida

Buying CBD oil online is by far the most secure and easiest method to locate dependable goods in Florida. Online providers typically offer greater rates than in-store retailers. Taking advantage of bulk bargains and special offers can help you save a lot of money.

Compared to in-store buying, online shopping allows you to rapidly compare items from several vendors without having to travel about looking for local suppliers. Making your purchase online allows you to swiftly investigate the firm and its items, providing you an advantage every time.
